My second anniversary since retirement also marks the end of my non-compete clause with the Foley firm. During this “sabbatical” a treatise on the Leahy Smith America Invents Act of 2011 has been a major project. It is now in process of print publication by Thomson Reuters and electronic publication on Westlaw.
Proposed Rules Changes: Attached is the first of a series of publications based upon research for the treatise, First-to-File Inspired Changes to the PTO Rules: Lessons from “First to File Patent Drafting”. It suggests rules changes that will facilitate earlier first filings by American inventors in the global “race to the Patent Office”.
