This Monday the Supreme Court Orders List is expected to announce whether certiorarihas been granted in two important cases, each with a much higher than average chance for grant of certiorari:
Top Ten No. (2) Sequenom v. Ariosa Diagnostic (patent-eligibility): Whether a method to determine the presence in a blood sample of a known substance (here, DNA) is patent-eligible under 35 USC § 101.
Top Ten No. (5) Life Tech. v. Promega (extraterritoriality): Whether supplying a single, commodity component of a multi-component invention from the United States is an infringing act under 35 U.S.C. § 271(f)(1).
